Terms of Service & Informed Consent

Introduction

Welcome to The Wholistic Health Center of Tucson. These Terms of Service and Informed Consent govern your use of our services and establish the agreement between you (the "Patient") and The Wholistic Health Center of Tucson and Jessica Montana, L.Ac. (the "Practice"). By receiving treatment at our clinic, you agree to these terms.

Patient Responsibilities

As a patient, I understand and agree that I must:

• Provide complete and accurate information about my medical history, current medications, and health conditions
• Inform the practitioner if I am pregnant or suspect I may be pregnant
• Notify the practitioner of any bleeding disorders or use of blood-thinning medications
• Report any infectious or communicable diseases
• Communicate any discomfort during treatment
• Follow treatment recommendations and self-care instructions
• Ask questions if any aspect of treatment is unclear
• Arrive on time for scheduled appointments

Scheduling

Appointments can be scheduled by calling (954) 951-5151 or emailing jessica@wholistichealthtucson.com. We strive to accommodate your scheduling needs within our office hours:

• Tuesday: 8:00 AM - 6:00 PM
• Wednesday: 8:00 AM - 6:00 PM
• Friday: 8:00 AM - 4:00 PM
• Closed: Monday, Thursday, and Weekends

Cancellation Policy

24-Hour Notice Required: Please provide at least 24 hours' notice if you need to cancel or reschedule your appointment. Late cancellations or no-shows may result in a charge equal to the full session fee.

Late Arrival

If you arrive late for your appointment, your treatment time may be shortened to avoid delays for other patients. The full session fee will still apply.

Financial Policies

Payment

Payment is due at the time of service. We accept:

• Check
• Major credit cards

Fees

Our fee schedule is available upon request. Fees are subject to change with reasonable notice.

Insurance

We do not directly bill insurance companies. However, we can provide you with a detailed receipt (superbill) that you may submit to your insurance company for possible reimbursement. Please check with your insurance provider about acupuncture coverage.

Treatment Guidelines

Right to Refuse or Discontinue Treatment

You have the right to refuse any treatment or discontinue treatment at any time. Please communicate your concerns with your practitioner so we can modify your treatment plan accordingly.

No Guarantee of Results

While many patients experience significant benefits from acupuncture and TCM treatments, individual results vary. We cannot guarantee specific outcomes or results from treatment.

Complementary Care

Acupuncture and TCM treatments are intended to complement, not replace, conventional medical care. We encourage you to inform your primary healthcare provider about your acupuncture treatments and to continue any prescribed medications unless advised otherwise by your prescribing physician.

Professional Boundaries

We maintain strict professional boundaries to ensure a safe and therapeutic environment:

• All treatments are provided in a professional, clinical setting
• Appropriate draping will be used to ensure privacy and comfort
• Sexual misconduct of any kind will not be tolerated
• Personal relationships outside the professional context are discouraged

Confidentiality

Your health information is confidential and protected under HIPAA and state privacy laws. Please refer to our Privacy Policy for detailed information about how we protect and use your health information.

Photography and Recording

No photography, video, or audio recording is permitted during treatments without explicit written consent from both the patient and practitioner.

Limitation of Liability

To the fullest extent permitted by law, The Wholistic Health Center of Tucson and its practitioners shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the services provided.

Dispute Resolution

Any disputes arising from these terms or the services provided shall first be addressed through good-faith discussion. If resolution cannot be reached, disputes shall be settled through mediation or arbitration in accordance with Arizona state law.

Governing Law

These terms shall be governed by the laws of the State of Arizona, without regard to its conflict of law provisions.

Modifications to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted in our office and on our website. Continued treatment after changes constitutes acceptance of the modified terms.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Service and Informed Consent, along with our Privacy Policy, constitute the entire agreement between you and The Wholistic Health Center of Tucson regarding our services.
